Terms & Conditions of Website Use and Trip Participation – Himalayan Hikers
The domain name www.himalayanhikers.in is owned and operated by Himalayan Hikers (Hereinafter known as ‘Himalayan Hikers'), company registered office at Village Sour, PO Sankri Mori Dehradun Uttarkashi Uttarakhand 249128.
By accessing or using this Website, or by booking a trip with Himalayan Hikers, you (“you” or “Participant”) agree to comply with and be legally bound by the following Terms and Conditions of Website Use and Trip Participation, along with our Privacy Policy and other applicable policies or disclaimers. If you disagree with any part of these terms, please do not use our Website or services.
1. Acceptance of Risk
- Participation in trekking, expeditions, and related outdoor activities (“Trek”) involves inherent risks, including injury, illness, accidents, or death.
- You voluntarily accept all such risks and agree to be fully responsible for your health, safety, and actions.
- You must disclose any relevant medical conditions and confirm your physical and psychological fitness prior to booking.
2. Booking and Payment
- Booking a trip signifies full acceptance of these Terms by the Participant.
- Accurate information must be provided during booking.
- Full payment must be made before the deadline; failure may result in cancellation without refund.
- Refunds, where applicable, shall be processed within 7–8 working days.
- Vouchers, promotions, and discounted bookings are non-refundable and non-transferable.
3. Participation by Minors
- Participants under 15 must be accompanied by a parent/guardian.
- Participants aged 15–18 may trek solo with a signed disclaimer from a guardian.
4. Cancellation and Refund Policy
- No refunds for voluntary withdrawal, late arrival, or disqualification for health/misconduct.
- If Himalayan Hikers cancels a Trip before departure due to Force Majeure, options include:
- Alternative trip/date
- Credit voucher (1-year validity)
Transfer to another trip with cost adjustments
- No refund if the Trip is aborted after reaching the base camp.
- We are not liable for third-party travel, accommodation, or visa costs.
Trek Date Change Policy
- All requests to reschedule a trek date must be submitted via email to: himalayanhikers.dun@gmail.com
- Such requests must be made at least 7 (seven) days prior to the originally scheduled trek date.
- The first date change request is permitted free of charge.
- From the second date change onward, a rescheduling fee of 10% of the total invoice amount will be applicable for each change.
- Once a date change has been processed, the booking becomes non-cancellable and non-refundable under all circumstances.
5. Safety and Medical Protocols
- Mandatory daily health checks (BP, oxygen, pulse) during trek.
- AMS awareness briefing is compulsory. Refusal may lead to denial of participation.
- Participants must carry all mandatory safety gear. Incomplete gear may lead to denial of trek entry.
- Participants showing AMS, critical vitals, or unfit behavior may be forced to descend.
- Headphones, noise-canceling devices, or electronic distractions are banned on trail.
- No participant may separate from the group or take alternate trails.
6. Emergency Evacuation and Consent
- Participants authorize Himalayan Hikers to initiate emergency evacuations at their cost.
- Once removed or evacuated, Himalayan Hikers bears no further responsibility.
- Evacuation waiver forms must be signed at base camp.
7. Health Certificate and Fitness Requirement
- Medical certificate from a registered doctor is mandatory for high-altitude or difficult treks.
- Disclosure of mental health history, including anxiety, phobias, or panic attacks, is compulsory.
8. Code of Conduct
- Alcohol, drugs, and smoking are strictly prohibited. Violators will be expelled without refund.
- Aggressive behavior, harassment, or group disruption will lead to trek removal and permanent blacklisting.
- Participants delaying or obstructing group progress may be asked to withdraw.
- If you physically push or shove any trekker, you will be removed from the trip.
9. Insurance
- Comprehensive insurance for high-altitude trekking, hospitalization, and cancellations is strongly recommended.
- Himalayan Hikers is not liable for claim rejections or third-party insurer obligations.
10. Website Use
- Website content may change without notice.
- Unauthorized use, copying, or linking is prohibited.
- Himalayan Hikers is not responsible for third-party website links.
11. Photography and Media
- Participant grants Himalayan Hikers rights to use photographs/videos for promotional use unless objected to in writing.
12. Data Privacy
- Personal data is collected only for operational/legal use and not shared without consent, except as required by law.
13. Dispute Resolution
- All complaints must be submitted via email within 7 days of trek completion.
- Disputes, if unresolved, will undergo arbitration in Dehradun under Indian Law.
14. Jurisdiction
- All legal matters shall fall under the exclusive jurisdiction of the courts in Dehradun [Uttarakhand].
15. Amendments
- Himalayan Hikers reserves the right to modify these Terms & Conditions at any time without prior notice.
